A metalworker accused of assault causing harm during an incident in South Dublin in which a man was fatally injured, has been granted High Court bail.

23-year-old Cristian Demian, of Howth Road, Raheny, was initially remanded in custody by Dún Laoghaire District Court two weeks ago, along with a second man, 21-year-old Kevin Rostas, a father of one, of Harrington Street, Dublin 8.

The two Romanian men are both accused of violent disorder at the South County Business Park, on the evening of 29 August.

A father of three, Mr Demian has an additional charge for assault causing harm to Siminic Rostas, who suffered “catastrophic injuries” and died three days later in Beaumont Hospital’s intensive care unit.

The two defendants brought an application to the High Court today, when Mr Justice Kerida Naidoo noted submissions from Keith Branagan BL for the pair. The judge held that a range of conditions could address garda concerns regarding bail.

Mr Demian’s bail was set at €1,000, along with the requirement for a €20,000 independent surety to be lodged in full before he can be released.

Kevin Rostas was granted bail on his own bond of €2,000, requiring an independent surety of €3,000. Both were remanded in continuing custody until their sureties are approved and the sums lodged.

Mr Justice Naidoo ordered that once released they must sign on daily at local garda stations, obey curfews, remain contactable by mobile phone at all times, and have no contact with witnesses.

Earlier, in the proceedings, gardaí alleged that at 8.25pm officers received a report of a large-scale disturbance involving several males engaged in violence at an abandoned premises.

Gardaí found three males, including Siminic Rostas, who were significantly injured, all requiring hospitalisation.

The court heard that initial inquiries have established that about 15 people, members of the Roma community, had resided at the vacant building for several months.

In evidence detectives said, “Initially, there was a verbal dispute which escalated suddenly to violence, and the subject of this row remains the subject of the Garda investigation”.

CCTV footage captured significant portions of the incident and has shown that lethal weapons and implements were used during the fight, including poles, sticks, and shovels.

Three other men are also accused of violent disorder in relation to the incident.
